ON
INCOGNITO CUSTOMS-INSPECTION IN THE IMPORT FIELD
THE MINISTER OF FINANCE,
Considering:
- a. that the performance of the apparatus of the Directorate General for Customs and Excise in organizing customs duty in the field of import has to be improved;
- b. that in the framework of improvement of supervision over the implementation of customs duties, it is necessary to assign the Inspectorate General of the Department of Finance to conduct incognito customs-inspection in the import field;
- c. that based on the matters set forth in paragraph a and b, it is necessary to stipulate a decree of Minister of Finance on incognito customs-inspection in the import field.
In view of :
- 1. Law No.10/1995 on Customs (Statute Book of 1995 No.75, Supplement to Statute Book No.3612);
- 2. Government Regulation No.21/1996 on Action-Taking In The Field of Customs (Statute Book of 1996 No.36, Supplement to Statute Book No.3626);
- 3. Presidential Decree No.165/2000 on Departmental Status, Duty, Function, Authority, Organizational Structure, and Work Procedure;
- 4. Presidential Decree No.177/2000 on Departmental Organizational Structure and Duty;
- 5. Decree of the Minister of Finance No.30/KMK.05/1997 on Procedure of Action-Taking in The Customs Field;
- 6. Decree of the Minister of Finance No.2/KMK.02/2001 on Organization and Work Procedure of Department of Finance;
- 7. Decree of the Minister of Finance No.444/KMK.01/2001 on Organization and Work Procedure of the Regional office of Directorate General for Customs & Excise and the Customs & Excise Service Office;
- 8. Decree of the Minister of Finance No.453/KMK.04/2002 on Customs Procedures In The Import Field.
DECIDES :
To stipulate:
DECREE OF MINISTER OF FINANCE ON SURPRISE INSPECTION INTO CUSTOMS IN THE FIELD OF IMPORT.
Article 1
The incognito customs-inspection in the import field, which is hereinafter referred to as "Incognito Inspection" is an inspection conducted at random into imported goods upon exit from the customs area.
Article 2
The inspection set forth in Article 1 shall be conducted by the Inspectorate General official.
Article 3
The provisions on the performance of surprise inspection into customs in the field of import will be further stipulated by the Inspector General and the Director General for Customs and Excise.
Article 4
The expenses arising from the enforcement of this decree shall be charged to the budget of the Ministry of Finance.
Article 5
This decree comes into full force and effect from April 1, 2003.
For public cognizance, this decree shall be announced by placing it in the State Gazette of the Republic of Indonesia.
